What Does Workers’ Compensation Cover?

Who Qualifies for Workers’ Compensation in North Carolina?
Most employees injured while performing their work duties qualify for benefits, including part-time and seasonal workers. To be eligible:
- Your employer must be required to carry workers’ comp insurance (generally 3+ employees)
- Your injury or occupational disease must arise out of and in the course of employment
- You must report your injury promptly, and file a claim on time

How to File for Workers’ Compensation Benefits
North Carolina requires specific steps and deadlines. Missing any of these can jeopardize your benefits, which is why legal guidance can be critical.
- Report your injury to a supervisor immediately and no later than 30 days.
- Seek medical treatment and notify the provider that the injury is work-related.
- File Form 18 (Notice of Accident to Employer and Claim of Employee) with the North Carolina Industrial Commission.
- The employer or its insurer must then accept or deny the claim.
- If denied, you may request a hearing by filing Form 33.

How Do Lost Wage Benefits Work?
If your injury prevents you from working, you may receive Temporary Total Disability (TTD) benefits. These payments generally equal about two-thirds of your average weekly wage, subject to statutory maximums, and begin after a short waiting period. If you can return to work only in a reduced capacity, you may be eligible for partial disability benefits.
Permanent impairment benefits are available when your doctor assigns an impairment rating after you reach maximum medical improvement.

Can I choose my own doctor?
Typically, your employer and insurance carrier select the treating physician. However, you may request a second opinion or petition for a change of doctor.
Can my employer retaliate against me for filing a claim?
No. Retaliation is prohibited under North Carolina law. We can and have filed separate lawsuits against employers who retaliate against employees when that occurs.
What happens if I cannot return to my job?
You may receive ongoing benefits and potentially vocational rehabilitation to help you transition into suitable employment. You may also be entitled to a lump sum payment based on a permanent impairment rating or in lieu of ongoing temporary total disability payments.
Do I need an attorney?
You are not required to hire counsel, but the system is complex. Employers and insurance companies often deny claims or underpay benefits.
