Who We Serve and How We Communicate
We regularly represent clients living both inside and outside the United States. Many of our clients live outside of Greensboro, North Carolina, and retain us through online appointments. Our staff speaks Spanish, Portuguese, and Russian, and we can use secure interpreter platforms or work with family interpreters when needed to ensure clear communication.
Do I Qualify? Understanding Eligibility
Immigration eligibility depends on visa type, immigration history, employment, criminal record, and family relationships. Requirements differ significantly between family-based petitions, employment visas, asylum claims, and adjustment of status. During consultation, we evaluate eligibility, identify potential risks such as unlawful presence, overstays, criminal convictions, or prior deportations, and recommend available legal paths.
Questions clients often ask include:
- How do I get a family-based green card?
- Can I petition for my spouse, parents, or children?
- What are the requirements for a work visa?
- What happens if my visa expires while I am here?
- How do I become a U.S. citizen?
- What if I was previously removed or denied?
We help clients understand rights and risks before filing applications.
Processing Times and How Long It Will Take
Timeframes vary based on case type, government processing backlogs, required interviews, and country of origin. Family petitions, employment visas, and waivers may take months or years depending on priority categories and visa availability. While no immigration attorney can guarantee processing speed, we provide realistic estimates and update clients as government filings progress through USCIS, NVC, consulates, or immigration courts.
What Happens if My Case Is Delayed or Denied?
If USCIS or another agency requests evidence, schedules an interview, or issues a denial, we analyze the decision and prepare appropriate responses. This may include motions to reopen or reconsider, administrative appeals on Form I-290B, or representation in immigration court for removal proceedings. For clients already ordered deported or held by ICE, we provide defense and pursue bond hearings when eligible.
What if I have a pending criminal case or traffic ticket in Guilford or Forsyth County?
Criminal and traffic charges, including DWI offenses, can carry immigration consequences for individuals who are not U.S. citizens. A conviction, guilty plea, or even certain outcomes short of conviction may influence immigration status, admissibility, or future applications. For this reason, it is extremely important for non-citizens to understand potential immigration effects before resolving a criminal or traffic case.
At A.G. Linett & Associates, PA, we handle criminal and traffic matters in Guilford and Forsyth Counties, and our attorneys are mindful of the ways these matters may relate to a client’s immigration situation. When appropriate, we consult internally between our criminal and immigration teams so clients receive informed guidance about possible risks and considerations.
What Can I Do Right Now?
Immigration cases require careful documentation and planning. Before applying, ensure that identification documents, passport records, immigration history, and family information are accurate and available. Avoid filing forms or making statements to border, airport, or immigration officials without understanding potential consequences. Early legal advice helps prevent avoidable delays, denials, and risks of removal.
